DMCA Policy

At Breakfast Tacos, we respect the intellectual property rights of others and expect our users to do the same. This DMCA Policy outlines the procedures for reporting alleged copyright infringement and for submitting counter-notifications regarding material removed from our services.

The Digital Millennium Copyright Act (DMCA) provides a mechanism for copyright holders to notify service providers like Breakfast Tacos when they believe their intellectual property rights have been infringed online.

Filing a DMCA Notice

If you are a copyright owner or an agent thereof and believe that any content hosted on or accessible through the Breakfast Tacos website or services infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Copyright Agent with the following information in writing:

  1. Identification of the copyrighted work claimed to have been infringed: This includes the URL of the original work, a copy of the work, or other clear identification of the copyrighted work.
  2. Identification of the material that is claimed to be infringing: Provide sufficient detail to allow us to locate the material on our site. This typically includes the specific URL(s) where the alleged infringing material is located.
  3. Contact information of the complaining party: Your full legal name, mailing address, telephone number, and email address.
  4. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright that is allegedly infringed.

Filing a DMCA Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with our Copyright Agent. Your counter-notification must be in writing and contain substantially the following information:

  • Identification of the material that has been removed or to which access has been disabled: Provide the specific URL(s) where the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • The subscriber's name, address, and telephone number.
  • A statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if the subscriber's address is outside of the United States, for any judicial district in which Breakfast Tacos may be found.
  • A statement that the subscriber will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
  • Your electronic or physical signature.
